1. Acceptance of Terms

By creating an account or using Umva SMS, you agree to these Terms, our Privacy Policy, and any additional policies we may post. You must be at least 16 years old to use our services.

2. Description of Services

Umva SMS provides a platform to automate SMS and WhatsApp messaging using your Android devices and WhatsApp account. Features include API integrations, bulk SMS, campaign management, and more, available for $2/month or $20/year. SMS costs are determined by your local mobile plan, and WhatsApp automation is free.

3. User Responsibilities

You agree to:

  • Provide accurate account information and keep it updated.
  • Use the platform in compliance with all applicable laws, including messaging regulations (e.g., TCPA, GDPR).
  • Obtain consent from recipients before sending SMS or WhatsApp messages.
  • Comply with WhatsApp’s policies for your connected account.
  • Not use the platform for illegal, abusive, or spammy activities, including sending unsolicited messages.
  • Secure your account with a strong password and protect your devices.

4. Payment and Subscription

Umva SMS offers subscriptions at $2/month or $20/year, payable in advance. You agree to:

  • Provide valid payment information and authorize recurring charges.
  • Notify us of any billing issues within 7 days of a charge.
  • Understand that subscriptions auto-renew until canceled via your account settings.
  • Note that refunds are not provided for partial subscription periods, except as required by law.

5. Intellectual Property

Umva SMS owns all rights to the platform, including its software, design, and content. You may not copy, modify, or distribute our materials without permission. You retain ownership of any data you upload (e.g., contact lists), but grant us a license to process it for providing services.

6. Prohibited Activities

You may not:

  • Reverse-engineer, hack, or interfere with the platform’s functionality.
  • Use the platform to send malicious content, such as malware or phishing links.
  • Overload our systems, including excessive API calls without authorization.
  • Impersonate others or create accounts with false information.

7. Termination

We may suspend or terminate your account if you violate these Terms, engage in illegal activities, or fail to pay subscription fees. You may cancel your subscription at any time via your account settings, but no refunds will be provided for partial periods. Upon termination, you must cease using the platform, and we may delete your data, subject to legal obligations.

8. Disclaimer of Warranties

Umva SMS is provided “as is” without warranties of any kind, express or implied. We do not guarantee uninterrupted service, error-free operation, or specific results from using the platform. You are responsible for your messaging costs via local mobile plans.

9. Limitation of Liability

To the fullest extent permitted by law, Umva SMS is not liable for indirect, incidental, or consequential damages arising from your use of the platform, including loss of data, profits, or business opportunities. Our total liability is limited to the amount you paid us in the past 12 months.

10. Indemnification

You agree to indemnify and hold Umva SMS harmless from any claims, losses, or damages arising from your use of the platform, violation of these Terms, or failure to comply with messaging laws or WhatsApp policies.

11. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any disputes will be resolved in the courts of [Insert Jurisdiction, e.g., Delaware, USA], unless otherwise required by law.
